All around the world the Governments try to figure out how to regulate interactive gaming. It’s not that easy as it seems. Many issues have to be considered, as for example any regulations are needed and how to deal with the fact that the internet knows no boundaries. South Africa is already a step further than the USA. While the US is still considering how to approach regulations of the online sector, South Africa already published the National Gambling Board’s (NGB’s) draft online regulations for public comment with the Department of Trade and Industry.

The point is, did South Africa really need to regulate the online gambling? Online gaming groups like Silversands and Piggs Peak are very successful also without any regulation. But there has to be a reason why at the end the country decided to regulate it. Actually there are some: one reason is that it was important to create an equal opportunity for all operators. Another reason is also the issue of consumer protection and money laundering, which happens when South African players use a nominated account to gamble online. Easy credit seems to be the biggest danger with online gaming.
An important issue is also the revenue, a big temptation for the government, with SARS charging a 6 % tax on all gaming revenue from operators to be licensed in terms of the new regulations.
Of course there are some difficulties too like for example the foreign exchange controls.
The Reserve Bank worked with the National Gambling Board to draw up the regulations and the Bank is aware of the internet not knowledge about the national jurisdictions and the free flow of money that will e crucial for the success of a local online industry.
